1. About These Terms
These Terms & Conditions apply to the use of the TopLine Plumbing & Gas website and, where incorporated into a quotation, booking or service agreement, the supply of services by TopLine Advanced Plumbing and Gas Pty Ltd.
By engaging us to perform work, accepting a quotation or otherwise agreeing to these Terms, you agree to be bound by the applicable provisions of these Terms.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

3. Quotes and Estimates
Unless otherwise stated, quotations are based on the information reasonably available to us at the time they are prepared.
A quotation may be subject to change where:
- The scope of work changes
- Additional work is requested
- Hidden or unforeseen conditions are discovered
- Information supplied to us was incomplete or inaccurate
- Additional materials or labour become necessary
- Site conditions materially differ from those reasonably anticipated
Where practicable, we will discuss material variations with the customer before proceeding with additional chargeable work.
A quotation does not constitute a booking until accepted and confirmed by TopLine.
4. Diagnostic and Investigative Work
Some plumbing problems cannot be accurately diagnosed until investigative work has commenced.
Where investigation reveals additional faults or work outside the original scope, TopLine may provide recommendations and additional pricing before further work proceeds where reasonably practicable.
Payment may still be required for diagnostic work, labour, attendance, equipment or materials already provided even where additional repairs are declined.
5. Pricing and GST
Prices will be stated as inclusive or exclusive of GST as specified in the relevant quotation, invoice or agreement.
Additional work outside an accepted fixed-price scope may be charged separately.
6. Payment
Payment is required in accordance with the payment terms shown on the relevant quotation or invoice.
Where deposits or progress payments are specified, work may be scheduled or continued subject to receipt of those payments.
The customer is responsible for ensuring payment is made using the payment methods specified by TopLine.
7. Cancellations and Rescheduling
Customers should provide reasonable notice if they need to cancel or reschedule a booking.
Where TopLine has incurred reasonable costs specifically for a customer's job, including specially ordered materials or other committed expenses, those costs may remain payable to the extent permitted by law.
Any cancellation fee will be disclosed where applicable and will be reasonable having regard to the circumstances.
8. Access to Property
The customer must provide reasonable and safe access to areas required for us to perform the agreed work.
The customer should disclose any known hazards, access restrictions or other relevant site conditions before work begins.
Delays or additional work caused by restricted access or undisclosed site conditions may result in additional charges where appropriate.
9. Existing and Concealed Conditions
Plumbing and gas work may involve existing installations, underground services, concealed pipework, ageing infrastructure and areas that cannot be inspected before work begins.
TopLine is not responsible for pre-existing faults or defects that were not caused by our work.
If previously concealed defects or unexpected conditions are discovered, we will advise the customer where reasonably practicable and may quote separately for additional work required.
10. Customer-Supplied Products
Where a customer supplies fixtures, appliances, tapware or other products, the customer is responsible for ensuring those products are suitable for the intended application unless TopLine has expressly agreed otherwise.
TopLine is not responsible for manufacturing defects in customer-supplied products or failures arising solely from unsuitable customer-supplied products.
Additional labour associated with replacing, modifying or rectifying customer-supplied products may be chargeable, subject to applicable consumer-law rights.
11. Materials and Products
Products and materials supplied by TopLine may be covered by applicable manufacturer warranties in addition to rights available under Australian Consumer Law.
Manufacturer warranty conditions may vary between products.
Nothing in these Terms limits any statutory consumer rights.
12. Australian Consumer Law
Our goods and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law where that law applies.
Among other protections, services must generally be supplied with due care and skill, be reasonably fit for a purpose made known to the service provider, and be provided within a reasonable time where no time has been agreed.
Nothing in these Terms is intended to exclude or restrict those rights. Contract terms cannot remove applicable consumer guarantees.
13. Workmanship and Rectification
If you believe there is a problem with work performed by TopLine, please contact us as soon as reasonably possible and provide details of the issue.
We may inspect the work to determine the cause and appropriate remedy.
Where TopLine is responsible for a failure covered by applicable law, we will provide the remedy required under Australian Consumer Law.
Issues caused by unrelated faults, misuse, third-party alterations, customer-supplied defective products or circumstances outside the original scope may constitute additional chargeable work, subject always to applicable consumer rights.
14. Damage and Site Restoration
We take reasonable care when carrying out work.
Some plumbing work may reasonably require access through walls, floors, ceilings, paving, cabinetry, landscaping or other finished surfaces.
Where such access is required, the scope and responsibility for reinstatement should be identified in the quotation where reasonably practicable.
Unless specifically included in our quotation, specialist reinstatement such as painting, plastering, tiling, cabinetry, landscaping or other non-plumbing trades may not be included in our price.
Nothing in this section excludes liability where it cannot lawfully be excluded.
15. Photos and Project Images
TopLine may photograph completed work for business records, quality assurance and, where appropriate, marketing purposes.
We will take reasonable steps not to intentionally publish personal information, identifiable occupants, private documents, vehicle registrations or other sensitive identifying information without appropriate permission.
Customers may ask us not to use photographs of their property for marketing purposes.
16. Website Information
Information provided on our website is general information only and should not be treated as technical advice for a particular plumbing or gas situation.
Images are illustrative of our work and may not represent the exact service, product or installation required for every property.
17. Third-Party Links and Services
Our website may contain links to third-party websites or use third-party platforms.
TopLine is not responsible for the content, availability or privacy practices of third-party websites that we do not control.
18. Intellectual Property
Unless otherwise stated, website content, branding, graphics, photographs and other original material owned by TopLine may not be reproduced or commercially used without permission.
Third-party trademarks and product names remain the property of their respective owners.
19. Limitation of Liability
To the maximum extent permitted by law, TopLine will not be liable for losses arising from matters outside our reasonable control or from pre-existing defects not caused by our services.
Nothing in these Terms excludes, restricts or modifies liability, guarantees, rights or remedies that cannot lawfully be excluded or restricted.
20. Governing Law
These Terms are governed by the laws applicable in Western Australia, Australia.
